Part I: General Terms of Service
The following terms apply to any User of the Easybankstatements Services


  1. Overview
    Please read these Terms of Service ("Terms") carefully before using the www.easybankstatements.com website (the “Platform”) operated by Easybankstatements Inc. ("Easybankstatements", "us", "we", or "our"). For purposes of these Terms, “you” and “your” means you as a user of the Platform. We may update these Terms from time to time by posting an updated version here. Easybankstatements enables businesses to seamlessly retrieval of bank statements
    and transactional banking data from end-user customers in an integrated platform geared towards financial service businesses. These Terms apply to all Users who wish to access the Platform or use the Services. Depending on the designation of your account, different services may be available to you depending on the User type you may have (“Services”). Certain Services may also only be available subject to the payment of such fees detailed on the Platform. Certain
    Users may also have additional terms and conditions applicable to their use of the Platform as described in these Terms. Easybankstatements reserves the right to modify or discontinue providing the Services or any part of them, at any time and without notice, at its sole discretion.

2. Definitions

Capitalized words in these Terms are defined as follows:

  • Account: an account to access and use the Platform in accordance with the applicable terms.

  • Administrator: Users with authority to, on behalf of a Business, apply for an Account, access the Services, manage an Account, and otherwise act on behalf of the Business.

  • Business: any type of legal entity with an Account created on Platform and managed through an Administrator.

  • Clients: Users who use the Platform to request Services and make payments through the Platform in connection with their receipt of any Services.

  • Content: all content on or made available on the Platform or through the Services, including any documents, images, photos, pictures, videos, data, audio or text, and any modifications or derivatives of the foregoing.

  • Contractors: Users who offer and perform services to Clients as described in contracts and who receive payments from Clients through the Platform.

  • Payment Service Provider(s): third-party financial service providers with respect to payment of funds by Users hereunder.

  • Users: any person authorized to access an Account.

User Content: all Content made available by Users on the Platform or through Services.

3. Platform Use and Eligibility


3.1. Subject to these Terms and related documents between you and Easybankstatements, Easybankstatements grants you a non-exclusive right to access and use the Platform and/or Services solely for your or the Business’ internal business purposes.

3.2. Use of and access to the Platform and/or Services is void where prohibited by law. By using the Services, you (where relevant on behalf of the applicable Business) represent and warrant that:

  • (a) any and all registration information you submit is truthful and accurate;

  • (b) you will maintain the accuracy of such information;

  • (c) your use of the Services does not violate any applicable law, regulation, or obligation you may have to a third party;

  • (d) you will comply with applicable laws, regulations, guidelines, these Terms throughout your use of the Platform and/or Services, as applicable.

3.3. We make the Platform and the Services available to Users who are 18 years of age or older. If you are aged between 16 and 17, you confirm that you have the permission and consent of a parent or legal guardian before utilizing the Platform and the Services. In cases where you are under 16, or if such usage is prohibited by law, you may not create an Account or use the Services. You must be a human to open an Account. Accounts registered by “bots” or other automated methods are not permitted. You may not maintain more than one Account at a time. By applying for an Account and using the Services, you represent and warrant that you are of legal age to form a binding contract and meet all of the foregoing eligibility requirements. If you do not meet these requirements, you may not access or use the Services or apply for an Account. Easybankstatements may refuse to open an Account for any individual or Business at its sole discretion.

3.4. If you are accessing or using the Services on behalf of a Business:

  • (i) you represent that you are authorized to enter into, and bind the Business to these Terms and register for the Services; and

  • (ii) the Business is legally and financially responsible for your access to and use of the Services, as well as for the use of the Services by others affiliated with you, including any employees, agents or contractors.

3.5. If we determine that any Content or the use of the Services violates these Terms, the Prohibited Activity List or any regulation, we may remove the Content or Services from your Account without prior notice to you. We may also suspend or close your Account. To the extent permitted by applicable law, we will provide you with notice of any of the foregoing promptly following taking any such action. Content or Services removed from your Account may not be edited or restored.

4. Easybankstatements Accounts

4.1. Applying for an Account. In order to access and use the Services, you will be required to create an account. To apply for an Account, you must provide your full legal name, a valid email address, your social security number, legal address and any other required information to complete the sign-up process, as requested by Easybankstatements. If you are applying for an Account on behalf of a Business, you may also be required to provide a business address, business ownership details, the nature of the business and additional business information that we may request. We will use this information to permit Easybankstatements and its financial partners to conduct due diligence on you prior to opening an Account, and throughout the course of our business relationship with you. Our use of your information is subject section 16 of these terms, Data Protection. If you are creating an Account on behalf of a Business, you must specify at least one Administrator. You are liable for any actions of your Administrator, and for any other person with access to your credentials or your Account. If you are an Administrator, you represent and warrant that you have the authority to apply for and to manage your Business’ Account.

4.2. Account Security. You are fully and solely responsible and liable for maintaining the privacy and security of your computer system, mobile device and all activity on your Account, even if such activities were not committed by you. You will promptly disable access to the Services if you believe your Account has been compromised or stolen, and you will immediately notify us if you believe your Account credentials have been compromised or stolen, and in the event of any unauthorized access to or use of your Account. Easybankstatements will not be liable for any losses or damage arising from unauthorized use of your account or password, and you agree to indemnify and hold Easybankstatements harmless for any unauthorized, improper or illegal use of your account and any charges and taxes incurred, unless you have notified us via e-mail at support@easybankstatements.com that your account has been compromised and have requested that we block access to it, which we will do as soon as reasonably practicable.

5. Content

5.1. Easybankstatements has no obligation to accept, display, or maintain any User Content. Moreover, Easybankstatements reserves the right to remove and permanently delete any User Content uploaded by you, without notice and for any reason. You are and shall remain at all times fully and solely responsible for any User Content that you upload to the Services. You represent and warrant that any User Content that you upload:

  • (i) complies with applicable law;

  • (ii) does not infringe or violate any third-party intellectual property rights, privacy or publicity rights, or moral rights; and

  • (iii) you have all necessary rights and authority to submit such User Content.

5.2. Without limiting the foregoing, you agree that you will not transmit, submit or upload any User Content to the Platform and/or Services or act in any way that:

  • restricts or inhibits use of the Services;

  • imposes an unreasonably or disproportionately large load on our infrastructure;

  • violates the legal rights of others;

  • infringes intellectual property rights;

  • involves stolen, illegal, counterfeit, fraudulent, pirated, or unauthorized material;

  • does not comply with applicable laws;

  • contains offensive, obscene, or harmful material.

5.3. Use Restrictions. You may not use the Platform and/or Services for any illegal, fraudulent or unauthorized purposes. You may not use the Platform and/or Services to violate intellectual property laws or rights of Easybankstatements or third parties. You may not use the Platform for personal, household, or consumer purposes only bona fide internal business purposes. You may not access the Platform from embargoed regions (Cuba, Iran, Syria, North Korea, Crimea, Luhansk, Donetsk). You may not use the Platform if you are a Restricted Party under U.S. sanctions.

5.4. If Easybankstatements suspects prohibited activity, it may disable your Account, freeze funds, and report activity to financial service providers or regulators.

8. Payment Plan

8.1. Certain Services require payment of fees outlined on the Platform. Clients may select a Payment Plan from the Pricing Page.

8.2. If paying by card or wire transfer:

  • You are responsible for foreign transaction fees.

  • Declined payments remain your responsibility.

  • Auto-payments may be charged automatically.

8.3. Easybankstatements may modify Payment Plan fees with 30 days’ notice. Continued use after changes constitutes consent.

8.4. Payment Plan fees exclude taxes. Clients are responsible for all applicable taxes.

8.5. Easybankstatements may offer Free Trials. If not canceled, Free Trials convert to paid plans.

8.6. Payment obligations cannot be canceled mid-cycle. Fees are non-refundable.

9. Integrations

9.1. The Services may integrate with third-party products (“Third-Party Product”). Use of such integrations is subject to third-party terms.

10. Communications from EasybankStatements

10.1. By creating an Account on our Platform, you agree that we may contact you in relation to the Services. By creating an Account, you also agree to subscribe to newsletters, marketing materials, and other promotional information we may send. You may opt-out of receiving any or all marketing communications by following the unsubscribe link or instructions provided in any email we send. Please note that we may still contact you with messages related to the Services even after you have opted out of marketing communications.

11. Electronic Signatures and Legal Notices


11.1. You agree that any signature, electronic symbol, or process attached to any document between you and EasybankStatements, or between you and another User, with the intent to sign, authenticate, or accept the terms of any Contract, or any electronic contract formation or record-keeping on the Platform, will have the same legal validity and enforceability as a handwritten signature or paper-based record, to the fullest extent permitted by applicable law.

11.2. You consent to receiving notices from EasybankStatements electronically and understand that this consent has the same legal effect as a physical signature.

11.3. Notices regarding account activity, alerts, and the Services may be provided electronically through your Account, email, or via text/SMS to the contact information you provide. These notices are considered received 24 hours after being sent. You understand that you cannot use the Platform or Services unless you consent to receive notices electronically. You may only withdraw consent by closing your Account.

11.4. You are responsible for receiving notices. Contact us immediately at support@easybankstatements.com if you experience issues receiving notices.

12. Interruption of Service

12.1. From time to time, the Platform and/or Services may be unavailable due to maintenance or updates. We will strive to minimize downtime but cannot guarantee continuous access. EasybankStatements is not liable for any losses or damages resulting from interruptions of the Platform or Services.

13. Intellectual Property

13.1. The Platform, Services, content (excluding User Content), APIs, interfaces, features, and functionalities remain the exclusive property of EasybankStatements and its licensors. The Platform and Services are protected by copyright, trademark, and other applicable laws. You may not use our trademarks, logos, or trade names without prior written consent, or remove or alter any proprietary rights notices.

13.2. By submitting User Content, you grant EasybankStatements a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, copy, distribute, modify, prepare derivative works, publicly display, or perform such User Content in connection with the Platform and Services in any media format.

14. Data Protection


14.1. You acknowledge and agree that EasybankStatements may collect and process your personal data in connection with your use of the Platform. We comply with all applicable data protection laws, including GDPR, CCPA, and any other relevant legislation. All rights and obligations of Users with respect to personal data are governed by the Data Processing Addendum (DPA).

15. Links to Other Websites or Services


15.1. The Platform may contain links to third-party websites or services not owned or controlled by EasybankStatements.

15.2. EasybankStatements is not responsible for the content, privacy policies, or practices of third-party websites or services and does not guarantee their offerings.

15.3. You agree that EasybankStatements is not liable for any damage or loss caused by use of or reliance on third-party websites or services.

15.4. You should review the terms of service and privacy policies of any third-party websites you visit.

16. Termination; Survival


16.1. EasybankStatements may terminate or suspend your Account and access to the Platform or Services immediately for any reason, including inactivity, breach of Terms, fraudulent or abusive behavior, illegal activity, or failure to make payment. Rejoining the Platform requires our written permission.

16.2. We may investigate violations of these Terms and cooperate with law enforcement or court orders to disclose User identity, behavior, or content.

16.3. You may request termination of your Account at any time by contacting support@easybankstatements.com. We will close your Account as soon as reasonably possible.

16.4. Termination or suspension does not affect obligations under Terms or agreements intended to survive, including Intellectual Property, Limitation of Liability, Arbitration, and Confidentiality.

17. Indemnification


17.1. EasybankStatements is not liable for acts or omissions of any User.

17.2. You agree to indemnify and hold harmless EasybankStatements, its affiliates, employees, and contractors from any claims, damages, losses, or expenses arising from:
(a) your use of the Platform or Services,
(b) breach of Terms,
(c) breach of any contract or payment agreement, or
(d) any content you post to the Platform.

18. Force Majeure

18.1. EasybankStatements is not liable for interruptions due to acts of God, network failures, power outages, viruses, strikes, legal or regulatory changes, or other events beyond our control.

19. Limitation of Liability


19.1. EasybankStatements is not liable for errors, omissions, interruptions, or unauthorized access to content or Services, or for damages to devices from using the Platform. You are solely responsible for the accuracy of data you provide.

19.2. IN NO EVENT WILL EASYBANKSTATEMENTS OR ITS AFFILIATES BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, WHETHER BASED ON CONTRACT, TORT, OR OTHER LEGAL THEORY.

19.3. MAXIMUM LIABILITY IS LIMITED TO THE GREATER OF FEES PAID IN THE THREE MONTHS PRIOR TO THE CLAIM OR $500.

20. Exclusions

20.1. Certain jurisdictions may not allow exclusion or limitation of liability for incidental or consequential damages, so the above limitations may not apply.

21. Governing Law

21.1. These Terms are governed by the laws of Ontario, Canada, without regard to conflicts of law. Arbitration will follow the JAMS rules as outlined below.

22. Arbitration and Dispute Resolution

22.1. You agree to first attempt to resolve disputes in good faith. Unresolved disputes will be settled by binding arbitration in Ontario, Canada under JAMS rules. Class actions are not permitted. You may seek injunctive relief in court pending arbitration. Fees will follow JAMS rules.

23. Confidentiality

23.1. “Confidential Information” means any business or technical information disclosed as confidential. Receiving Party will not use Confidential Information except to perform obligations under these Terms. User Content is considered confidential to the User, but EasybankStatements may use it for internal purposes, including product improvement or service recommendations.

24. Miscellaneous

24.1. We may modify or replace Terms at our discretion with notice. Continued use of the Platform after changes constitutes acceptance.

24.2. If a provision is unenforceable, it will be replaced with a valid provision that achieves the original intent.

24.3. EasybankStatements may assign its rights or obligations to third parties. Users may not assign their rights or obligations.

24.4. Failure to enforce any right is not a waiver of that right.
